I-9 Changes for ALL Employees Starting in November

The new E-Verify process affects everybody, you too! 

 Emily has remote employees in multiple states and her company is growing, she is concerned about the USCIS ending of the Covid-19 flexibilities ending in regard to remote employee verification.  Good news for Emily, USCIS has created a new form, here is how it works. Emily can feel secure about compliance and avoiding an audit.  

U.S. Citizenship and Immigration services updated Employment Eligibility Verification also known as Form I-9 on August 1, 2023.  The previous revision took place in 2020 to allow employers to inspect and verify documents remotely due to the Covid-19 emergency. When President Biden officially ended the Covid-19 crisis on May 11, 2023, there were concerns by companies who had adapted to a changing remote based workforce that remote verification would disappear. The latest updates took effect on August 1, 2023.   

Key points to remember: 

  • If you already participate in E-Verify you are good to go! Here is a handy flowchart of the NEW E-VERIFY PROCESS . 
  • If you were not enrolled in E-Verify you mut complete an in-person physical examination of the documents. 
  • Starting Nov. 1, 2023 all employers must use the new Form I-9.
